Terms and Conditions

The LifeShield product requires monitoring service to function, and can only be monitored by LifeShield. A Product and Service Agreement is required for purchase. Purchase must take place through the LifeShield call center, at LifeShield.com or through a preferred partner or authorized dealer. Promotional offers, pricing, and product availability vary based on satisfactory credit history, homeownership, installation needs and length of the contract term. Any up front activation fees, shipping, lease fees, warranty fees, and installation fees are due at point of purchase. Customers who purchased on a lease based contract are responsible for the MSRP value of leased equipment and the total monitoring contract value. Customers who purchased with a standard service contract where they own the product are responsible for the total monitoring contract value until the completion of the initial term of the Product and Service Agreement. Contracts not in good standing may be sent to collections and result in discontinued monitoring service. Free LifeShield Interactive Monitoring access is offered with many of our security products. Customers must be in good standing based on contract terms to continue to have access to LifeShield Interactive. Some homeowner insurance companies offer discounts on their annual price for policyholders with homes protected with professional security and fire protection. Taxes

Product and service taxes for your respective state apply and may not be reflected in the prices published on the service agreement.

Self-Installation

You agree to follow our instructions regarding such self-installation. You agree that (i) you are ultimately responsible for any installation work you undertake to perform, and we will not be liable for any consequences of, or be otherwise responsible for, any such work, and (ii) your Service billing commencement date will be the earlier of (a) the date of Service activation, or (b) the date of shipment of the System to you. LifeShield shall provide notice to you via email that the System has been shipped to your address.

Monitoring Services:

All monitoring can only be used with LifeShield product purchased through the LifeShield call center, at LifeShield.com or through a preferred partner or authorized dealer. Monitoring requires customer to have a valid, in good standing, Product and Service Agreement. Security kits or products purchased from unauthorized parties or via transfer of ownership must undergo new ownership contract creation and be in good standing to start and continue monitoring. Please see your contract for details on monthly monitoring payments, making service payments, staying in good standing, collections and unsuccessful billing implications. You are responsible for the total value of the contracted monitoring term. Service fees can be raised according to the terms disclosed in the contract. Monitoring for burglary, fire, carbon monoxide, flood, freezing, and medical emergencies require the purchase, setup and activation of the LifeShield product. Prices for these monitoring options will vary based on promotional offer, product purchased, credit history, homeownership, and contract length. Prices are subject to change. Full coverage for burglary, fire, carbon monoxide, flood, freezing, and medical emergencies may require the purchase of additional LifeShield products. Personal monitoring services are available as part of all contract based monitoring packages. Use of personal monitoring does not include notification of emergency services. Certain products like the water/temperature sensor can only trigger personal monitoring. Personal monitoring allows for notifications via email or text to the contacts provided upon notification setup.

Professional monitoring services are offered with all kit packages available and require a Product and Service Agreement. Prices vary based on credit history, home ownership, and service agreement length. Professional monitoring includes access to the LifeShield Interactive website, emergency service (professional) monitoring, and personal monitoring. Prices start at $20.99 per month and have term length conditions.

Full House Fire and Carbon Monoxide Protection

Fire Safety Sensor (Siren detector) works with existing interconnected smoke detectors and carbon monoxide detectors within your home. May require additional purchase of these products if you do not already have them. LifeShield’s Siren Detector (Fire Safety Sensor) must be purchased and full professional monitoring must be in place. Requires a Product and Service Agreement and consumer to be in good standing according to the terms of that agreement. We do not support any non-residential or business location for fire, smoke, or heat detection, and local fire marshal codes will vary based on location. We do not provide any warranties regarding fire, smoke, or heat protection for business users.

Security Kit, Monitoring and Back-up Protection

The LifeShield product supports 4 layers of communication. Requires purchase of professional monitoring. A phone line is needed for all 4 layers of communication, but not required in order to use any of the LifeShield Home Security kits. Call for details.

Money Back Guarantee and Return Policy

  1. Return Policy. You can return the System for any reason and cancel the Product and Service Agreement  without incurring an early cancellation fee within 30 days of your order. Upon the termination of the Agreement, you shall return any leased equipment. This Section shall also apply to any purchased equipment being returned; except that if you fail to return the equipment you will not be charged the Equipment Non-Return Fee nor will you receive a refund for the equipment purchased. Please call 1-888-723-8894 within seven (7) days of termination to receive a Return Material Authorization (RMA) number. After we issue an RMA, you must send back to us such leased System equipment as we may instruct you when issuing the RMA (the “Required Equipment”). Unless otherwise requested by us, the Required Equipment will not include sensors, which may be retained by you, and we reserve the right to abandon any components of the System and will not be liable for any costs or damages associated with their recovery. There is no option to purchase components of the System that you lease. You must return the Required Equipment to our warehouse within twenty-one (21) calendar days of the issuance of the RMA. You will be required to provide proof of delivery if requested. The Required Equipment must be returned in good working order, normal wear and tear excepted. If you fail to return Required Equipment in accordance with the terms of this Paragraph 18, WE WILL CHARGE YOU AN EQUIPMENT NON-RETURN FEE OF four hundred twenty five dollars ($425.00) for leased Systems that includes a leased camera and three hundred twenty five dollars ($325.00) for leased Systems that do not include a leased camera. You understand and agree that the equipment non-return fee is subject to adjustment based on the value of any new or replacement System that we may provide to you during the term of this Agreement.
  2. OwnershipFor non-leased equipment, the System will become your property upon payment in-full of the Amount Due at Purchase, including all applicable sales tax. Your right to display the yard signs and decals on your property during the term of this Contract is not transferable.
  3. Risk of Loss. We are not responsible for loss or damage to your System or our equipment due to events or circumstances beyond our control. NO SUCH LOSS OR DAMAGE WILL RELIEVE YOU OF YOUR OBLIGATIONS UNDER THIS CONTRACT. You should keep your System insured against risk of loss in an amount equal to its replacement cost.

IF YOU TERMINATE THIS AGREEMENT PRIOR TO FULFILLING YOUR OBLIGATIONS DURING THE INITIAL TERM (INCLUDING BY FAILURE TO PAY), WE MAY CHARGE YOU AN EARLY CANCELLATION FEE EQUAL TO YOUR MONTHLY SERVICE FEE PLUS APPLICABLE TAXES MULTIPLIED BY THE NUMBER OF MONTHS REMAINING IN THE INITIAL TERM. THERE IS NO EARLY CANCELLATION FEE FOR AGREEMENTS ON MONTH TO MONTH TERMS. THE EARLY CANCELLATION FEE IS A LIQUIDATED DAMAGE, NOT A PENALTY, AND WAS REASONABLY CALCULATED TO REPRESENT THE AMOUNT OF DAMAGE WE SUSTAIN WHEN CUSTOMERS BREACH THIS AGREEMENT BY TERMINATING PRIOR TO THE END OF THE INITIAL TERM. WE RESERVE THE RIGHT TO CHARGE THE EARLY CANCELLATION FEE TO THE CREDIT OR DEBIT CARD YOU HAVE ON FILE WITH US.
You can cancel this Agreement without incurring an early cancellation fee as follows:

- You can cancel this Agreement without incurring an early cancellation fee not later than 30 days after your order date pursuant to the term of Return Policy set forth above. If you cancel pursuant to this provision, any shipping and installation fees previously paid are non-refundable.

- For all residential customers, in addition to your right to cancel above (if applicable): FOR RESIDENTIAL CUSTOMERS IN FLORIDA, YOUR RIGHT TO CANCEL: IF YOU DO NOT WANT THE GOODS OR SERVICES, YOU MAY CANCEL THIS AGREEMENT BY PROVIDING WRITTEN NOTICE TO THE SELLER IN PERSON, BY TELEGRAM, OR BY MAIL. THIS NOTICE MUST INDICATE THAT YOU DO NOT WANT THE GOODS OR SERVICES AND MUST BE DELIVERED OR POSTMARKED BEFORE MIDNIGHT ON THE THIRD BUSINESS DAY AFTER YOU SIGN THIS AGREEMENT. IF YOU CANCEL THIS AGREEMENT, THE SELLER MAY NOT KEEP ALL OR PART OF ANY CASH DOWN PAYMENT. YOU MAY ALSO CANCEL THIS AGREEMENT IF UPON A DOCTOR’S ORDER YOU CANNOT PHYSICALLY RECEIVE THE SERVICES, AND YOU WILL NOT BE CHARGED ANY EARLY TERMINATION FEE. IF YOU CANCEL THIS AGREEMENT FOR THIS REASON, LIFESHIELD MAY KEEP ONLY A PORTION OF THE FEES EQUAL TO A PRO RATA PORTION OF THE TOTAL PRICE REPRESENTING THE PROPORTION OF SERVICES YOU USED OR COMPLETED, PLUS THE COST TO LIFESHIELD OF ANY RELATED GOODS WHICH YOU HAVE CONSUMED OR RETAINED. THIS AGREEMENT IS FOR FUTURE CONSUMER SERVICES AND PUT ALL ASSIGNEES ON NOTICE OF THE CONSUMER’S RIGHT TO CANCEL UNDER CHAPTER 2-18, FLORIDA ADMINISTRATIVECODE. While Florida residents are entitled to this cancellation standard, you will still be entitled to the extended cancellation periods in the prior section should your particular installation qualify. 

- FOR OTHER RESIDENTIAL CUSTOMERS, YOU, THE CUSTOMER, MAY CANCEL THIS AGREEMENT AT ANY TIME PRIOR TO MIDNIGHT OF THE THIRD BUSINESS DAY AFTER THE DATE OF THIS TRANSACTION. UPON CANCELLATION, IN ORDER TO AVOID NON-RETURNED EQUIPMENT FEES, YOU MUST RETURN THE EQUIPMENT COMPRISING THE SYSTEM BACK TO US IN ACCORDANCE WITH THE RETURN POLICY.

You may cancel security monitoring services if you are a member of a branch of the United States armed forces or reserves and get called for military duty away from your residence. You must contact us by calling 1-888-723-8894 and provide proof of your service by mailing the supporting paperwork to corporate headquarters after speaking with a LifeShield Security Advisor.
Service may also be cancelled if the subscriber dies during the term of the service agreement. The executor of the Subscriber’s estate or next of kin should contact us and provide us with a valid death certificate. Upon receipt of a valid death certificate, we will terminate the security agreement without penalty.

LifeShield contracts renew per the terms of the initial product and service contract. Subscribers that do not intend to renew need to give at least 15 days written notice of the intention to not renew prior to the start of the renewal term, per your service agreement.

Warranty

Limited Warranty on Leased Products; Product Warranty Disclaimer.

THE FOLLOWING LIMITED WARRANTY IS APPLICABLE TO LIFESHIELD-BRANDED PRODUCTS THAT YOU PURCHASE: i. LifeShield will repair or replace any defective LifeShield equipment (with new or refurbished equipment, at LifeShield’s sole option) that you purchase at no cost to you for a period of 12 months from the date of purchase; ii. You will receive a prepaid mailing label to return any defective system equipment; iii. You are responsible to pay shipping costs for any replacement equipment; iv. After the expiration of the 12-month warranty period you are responsible for the cost of all replacement equipment, including all shipping charges; v. If you fail to return the defective equipment you void this warranty and must pay LifeShield the MSRP for the equipment.

b. THE FOLLOWING LIMITED WARRANTY IS APPLICABLE TO LIFESHIELD-BRANDED PRODUCTS THAT YOU LEASE: i. Your LifeShield leased equipment is warranted for the full term of the Lease provided you remain in good standing; ii. Any defective leased system equipment will be repaired or replaced (with new or refurbished equipment, at LifeShield’s sole option) at no cost to you; iii. You will receive a prepaid mailing label to return any defective leased system equipment; iv. If you fail to return the defective equipment you void this warranty and must pay LifeShield the MSRP for the equipment

c. Subject to the terms of the Limited Warranties set forth above, you are responsible for the loss of, damage to, or the entire cost of, any necessary service or repair of the System equipment. THE LIMITED WARRANTY DOES NOT APPLIY TO PROMOTIONAL ITEMS OR GIFTS. Read Section 16 for other important limitations and exclusions. You have no right to sell, give away, transfer, pledge, mortgage, alter or tamper with the equipment. OTHER THAN THE REPAIR AND REPLACEMENT SERVICES FOR THE SYSTEM OR ANY COMPONENT THEREOF, WE MAKE NO WARRANTY OR REPRESENTATION, EITHER EXPRESS OR IMPLIED, REGARDING ANY SERVICE OR EQUIPMENT, WHICH IS PROVIDED TO YOU AS IS AND WITH ALL FAULTS. ALL SUCH WARRANTIES, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE EXPRESSLY EXCLUDED. LIFESHIELD IS NOT RESPONSIBLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RELATING TO LEASED SYSTEM EQUIPMENT OR ANY ACCESSORIES/CUSTOMER PURCHASED EQUIPMENT. By leasing from us, you acknowledge that you have had an opportunity to review our warranty terms, have done so to the degree you feel you need to be familiar with them, and you accept their terms and conditions, including the limitations, exclusions, and disclaimers. STATE LAW: Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the disclaimers, exclusions or limitations may not apply to you, and you might have additional rights.

Limitations on our Limited Warranty. We have no obligation under our Limited Warranty if we reasonably determine that your need for service was caused by any event, condition or circumstance beyond our control, other than ordinary wear and tear to your System. For example, our Limited Warranty does not cover any of the damage or loss of use resulting from, or necessary because of, any of the following: natural disasters, fires, storms, accidents, acts of God, strikes, riots, floods, or terrorism, Furthermore, our Limited Warranty does not cover any of the damage or loss of use resulting from, or necessary because of, any of the following: (A) your misuse of, or tampering with, the System; (B) telephone line malfunctions or modifications to your telephone service that render it incompatible with your System; (C) your failure to provide ordinary maintenance to your System or any accessories/customer purchased equipment; (D) anyone other than our authorized representative performing service on your System, except at our specific direction; (E) physical alterations made by you or third parties to your Premises or to your System, or made necessary by damage to your Premises or your System; (F) any change in laws or regulations that make it impossible or impracticable to continue use the System as is; or (G) any other reasons beyond our control. You must furnish the necessary electrical power through your meter at your expense to obtain warranty services.

You will receive instructions on how to ship the Products, at your expense, to a LifeShield Authorized Repair Center. To obtain service, you must include:

1. A copy of your receipt, bill of sale or other comparable proof of purchase;
2. A written description of the problem;
3. The complete physical address of the location where the system was installed and most importantly;
4. Your address and telephone number; and,
5. The “Return Merchandise Authorization” or “RMA” number that LifeShield provides to you.

 What is Not Covered (Exclusions):

Normal Wear and Tear: Periodic repair and replacement of parts due to normal wear and tear are excluded from coverage.

Ornamental Decorations. Ornamental decorations such as emblems and graphics and other decorative elements, are excluded from coverage.

Abuse & Misuse. Defects or damage that result from the following are excluded from coverage:

1. Improper operation, storage, misuse or abuse, accident or neglect, such as physical damage (cracks, scratches, etc.) to the surface of the Product;
2. Contact with moisture, liquids, water, rain, extreme humidity, heavy perspiration or makeup, sand, dirt or the like, food, or proximity to or exposure to heat or cold, fire, flood, or lightning;
3. Other acts which are inconsistent with the instructions and documentation that accompany the Products; and
4. Use of the Products with any system other than the LifeShield Security System.

 Use of Non-LifeShield Products and Accessories:

Defects or damage that result from the use of Non-LifeShield branded or certified products, accessories, software or other peripheral equipment are excluded from coverage, including without limitation defects or damage to Products that result from such use are excluded from coverage.

 Unauthorized Service or Modification:

Defects or damages resulting from service, testing, adjustment, installation, maintenance, alteration, including without limitation, software changes, or modification in any way by someone other than LifeShield, or its authorized agents, are excluded from coverage.

 Altered Products:

Products with the following characteristics are excluded from coverage:

1. Serial numbers or date tags that have been removed, altered or obliterated;
2. Broken seals or Products that show evidence of tampering;
3. Mismatched board serial numbers; or
3. Nonconforming or non-LifeShield housings, antennas, or parts.

 Communication Services:

Defects, damages, or the failure of Products due to any communication service or signal not provided directly by LifeShield is excluded from coverage.

 Out of Warranty Products:

Defects or damages reported to LifeShield after the Warranty Period are excluded from coverage.

 Other Exclusions And Limitations:

ANY IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY LIMITED IN DURATION TO THE TERM OF THIS EXPRESSED WARRANTY. THE REPAIR OR REPLACEMENT AS PROVIDED UNDER THIS EXPRESS LIMITED WARRANTY IS THE SOLE AND EXCLUSIVE REMEDY OF THE CONSUMER, AND LIFESHIELD’S SOLE AND EXCLUSIVE LIABILITY HEREUNDER, AND IS PROVIDED IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED. IN NO EVENT SHALL LIFESHIELD BE LIABLE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, FOR DAMAGES IN EXCESS OF THE PURCHASE PRICE OF THE PRODUCT GIVING RISE TO THE DAMAGES, OR FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR LOSS OF REVENUE OR PROFITS, LOSS OF BUSINESS, LOSS OF INFORMATION OR DATA, SOFTWARE OR APPLICATIONS OR OTHER FINANCIAL LOSS ARISING OUT OF OR IN CONNECTION WITH THE USE OF OR THE ABILITY OR INABILITY TO USE THE PRODUCTS OR SOFTWARE TO THE FULL EXTENT THESE DAMAGES MAY BE DISCLAIMED BY LAW.

SOME STATES AND JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR A LIMITATION ON THE DURATION OF IMPLIED WARRANTIES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE OR FROM ONE JURISDICTION TO ANOTHER.
